1. Definitions

In these Terms and Conditions:

  • "Company," "We," "Us," "Our" refers to Maretide
  • "Client," "You," "Your" refers to the person or entity booking a charter
  • "Charter" refers to the yacht hire agreement and associated services
  • "Vessel" refers to the yacht or motor vessel used for the charter
  • "Passenger" refers to individuals aboard the vessel during a charter
  • "Crew" refers to skipper, deckhand, and other staff operating the vessel

2. Acceptance of Terms

By booking a charter with Maretide, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not proceed with a booking.

These terms constitute a legally binding agreement between you and Maretide. The person making the booking must be at least 18 years of age and have the legal capacity to enter into contracts.

3. Booking and Payment

3.1 Booking Procedure

Charters are confirmed upon receipt of:

  • Completed booking form with passenger details
  • Deposit payment as specified below
  • Acceptance of these Terms and Conditions

3.2 Payment Terms

  • Deposit: 30% of charter price due at booking
  • Balance: Remaining 70% due seven days before charter date
  • Currency: All prices quoted in Malaysian Ringgit (MYR)
  • Methods: Bank transfer or approved credit cards

3.3 Additional Costs

The charter price includes vessel, fuel, crew, and provisions as specified in the charter description. Additional costs may include:

  • Indonesian clearance documentation (Singapore Strait voyage)
  • Special dietary accommodations beyond standard provisions
  • Extended charter hours beyond agreed schedule

4. Cancellation and Refunds

4.1 Client Cancellation

  • More than 14 days before charter: Full refund minus 10% administration fee
  • 7-14 days before charter: 50% refund
  • Less than 7 days before charter: No refund

4.2 Weather Cancellation

If the charter is cancelled by Maretide due to unsafe weather conditions:

  • Full refund OR rescheduling to alternative date at no additional cost
  • Weather assessment is at the skipper's sole discretion
  • Decision is final and made in the interest of passenger safety

4.3 Vessel Unavailability

If Maretide cannot provide the charter due to vessel mechanical issues or crew unavailability, clients receive full refund or may reschedule without penalty.

5. Client Responsibilities

5.1 Passenger Information

You must provide:

  • Accurate passenger names and emergency contact details
  • Information about any medical conditions affecting charter safety
  • Dietary requirements at least 72 hours before charter

5.2 Passenger Conduct

All passengers must:

  • Follow crew instructions regarding safety and vessel operation
  • Arrive at departure point 15 minutes before scheduled time
  • Refrain from behavior that endangers vessel or other passengers
  • Not bring illegal substances aboard
  • Not board the vessel while intoxicated

5.3 Capacity Limits

The number of passengers must not exceed the stated capacity for the charter. Additional passengers cannot be accommodated for safety and regulatory reasons.

6. Skipper's Authority

The skipper has absolute authority regarding:

  • Safety decisions including route changes or charter termination
  • Departure and return timing based on weather conditions
  • Removal of passengers whose behavior poses safety risks
  • All matters relating to vessel operation and navigation

The skipper's decisions are final. No refund is provided if a charter is terminated early due to passenger conduct or safety concerns.

7. Limitation of Liability

7.1 Company Liability

Maretide maintains comprehensive marine insurance. Our liability is limited to:

  • Direct damages resulting from our negligence
  • Amounts recoverable under our insurance policies
  • Maximum of the charter price paid

7.2 Exclusions

We are not liable for:

  • Personal injury resulting from passenger failure to follow crew instructions
  • Loss or damage to personal belongings
  • Indirect or consequential losses
  • Weather-related itinerary changes
  • Acts of third parties or force majeure events

7.3 Passenger Assumption of Risk

Yacht charters involve inherent risks. By participating, passengers acknowledge these risks and agree to follow safety protocols.

8. Insurance

Maretide maintains marine insurance covering vessel damage and third-party liability. This insurance does not cover:

  • Passenger personal medical expenses
  • Travel insurance for charter participants
  • Personal belongings or valuables

We strongly recommend clients obtain appropriate travel insurance covering medical emergencies, trip cancellation, and personal property.

9. Intellectual Property

All content on our website, including text, images, logos, and design elements, is owned by Maretide or licensed to us. You may not:

  • Reproduce, distribute, or modify our content without permission
  • Use our trademarks or branding without authorization
  • Commercially exploit our website content

10. Photography and Media

By participating in a charter, you consent to:

  • Photography or video recording during the charter for promotional purposes
  • Use of such media on our website and marketing materials

If you prefer not to be photographed, please inform crew members before departure.

11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute, we encourage clients to contact us directly to seek resolution. Most concerns can be addressed through direct communication.

11.2 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.

11.3 Mediation

Where appropriate, parties may agree to submit disputes to mediation before pursuing legal action.

12. Force Majeure

Maretide is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including:

  • Severe weather or natural disasters
  • Government restrictions or maritime authority closures
  • Labor disputes or strikes
  • Equipment failure despite proper maintenance
  • Pandemic or public health emergency

In such cases, we will work with clients to reschedule or provide refunds as appropriate.

13. Changes to Terms

Maretide reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date.

Bookings made before changes take effect are governed by the terms in place at the time of booking. New bookings are subject to the current terms.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with the booking confirmation and charter description, constitute the entire agreement between you and Maretide. Any prior discussions or representations not expressly stated herein are superseded.
